“97 tickets” Contest
Official Rules:
Hershey Entertainment & Resorts Company (“HE&R”) presents
the “97 tickets” contest (“Contest”). HE&R
reserves the right to discontinue the Contest at any time up to the date
of the Contest.
Twenty-three (23) winners will each receive one 4-pack of regular one-day
admission tickets to Hersheypark Amusement Park (“HERSHEYPARK”)
valid during the park’s 2008 public operating season. The approximate
retail value of each 4-pack is $191.80. One grand prize winner will receive
five (5) regular one-day admission tickets to HERSHEYPARK valid during
the park’s 2008 public operating season (the “Grand Prize”).
The approximate retail value of the Grand Prize is $239.75. Use of the
prizes are based on availability, which will be determined by HE&R.
The prizes must be redeemed by September 27, 2008. The prize winners are
responsible for transportation (including all costs associated therewith),
gratuities and incidentals, meals, and all other expenses not specifically
included in these rules. The prizes are not transferable. No
prize substitutions, exchanges or cash equivalents will be permitted by
the winner, except that HE&R reserves the right to substitute a prize
of comparable or greater value if deemed necessary by HE&R in its sole
discretion.
2. HOW TO ENTER:
NO PURCHASE NECESSARY TO ENTER OR WIN. Individuals age 18 or older
will be entered into the Contest:
- ON-LINE – by completing an Official Entry Form online at Hersheypark.com/contests,
between 12:01 A.M. EST on February 14, 2008 and 11:59P.M.
EST on May 27, 2008 (the “Contest Period”); or
- MAIL – by mailing a 3x5 card or postcard (with your name, birth
date, address, and phone number) between February 14, 2008 and
May 27, 2008 inclusive to: “97 Tickets Contest” c/o
HE&R
Marketing Department, 27 W. Chocolate Avenue, Hershey, PA 17033. Mail
entries must be received no later than May 27, 2008
to be eligible.
Only completed official entry forms submitted during the Contest Period
will be accepted as an eligible entry form. HE&R retains the
right to disqualify any entry that has been incorrectly completed. Once
submitted, all materials become the property of HE&R and will not be
acknowledged or returned. Only one entry per person.
By participating in the Contest, all participants and entrants agree to
be bound by these Official Contest Rules and the decisions of judges and
the decisions of Hershey Entertainment, which are final, and waive any
right to claim ambiguity in the Official Contest Rules.
3. ELIGIBILITY
The Contest is open only to legal residents of the United States
of America who are age 18 or older, except employees of HE&R, its
affiliates, subsidiaries, agents, or any of its advertising agencies
or promotional suppliers participating in this Contest and the immediate
families or household members of each are not eligible to participate
in this Contest. Void where prohibited or restricted by law.
4. ENTRY FORMS:
HE&R is not responsible for lost, interrupted or unavailable network,
server or other connections, miscommunications, failed telephone or computer
hardware or software or other technical failures, unauthorized human intervention,
garbled or jumbled transmissions or other errors of any kind, whether human,
mechanical or electronic, including without limitation, the incorrect or
inaccurate capture of entry information online regardless of cause. In
the event of a dispute involving the ownership of an email entry form submission,
the entry will be deemed submitted by the holder of the email account. In
addition, HE&R is not responsible for late, lost, damaged, misdirected,
illegible, incomplete or postage-due mail entries, prize claims or requests. HE&R
retains the right to disqualify any entry that has been incorrectly completed.
5. ODDS OF WINNING:
The odds of winning the prizes depend solely on the total number
of eligible entries received by HE&R during the Contest Period.
6. SELECTION OF WINNERS:
The winners will be chosen on or about May 27, 2008 from
a random drawing of all eligible entries received. The decisions
of HE&R are final on all matter relating to the Contest. The
winners will be notified by telephone and mail. Alternate Winner(s)
will be selected on an as needed basis in the event that the winner is
ineligible, declines the Grand Prize or cannot be located. All prizes
are subject to verification. The winner will be required to sign
and return an Affidavit of Eligibility & Liability/Publicity Release
or the prize will be forfeited. By accepting the prizes, the winners
agree to release and hold harmless HE&R, and the representatives, affiliates,
owners, directors, officers, employees and assigns of each, from any and
all claims, losses, injuries, liabilities, or damages of any kind arising
out of or in connection with their participation in the Contest or the
award, acceptance, possession, use or misuse of the prizes or participation
in any prize related activity. By participating in the Contest all
participants agree to allow HE&R, its agents and service providers
to use any participant’s image, likeness, photograph, and voice transmissions,
however recorded in connection with the Contest, in addition to the name,
city and state of residence of the Grand Prize winner, without any additional
compensation. Permission is granted by participants and their parent
or legal guardian for any use, now or in the future, in connection with
the Contest and/or the marketing of HE&R.
7. ADDITIONAL RESTRICTIONS AND GENERAL CONDITIONS:
Void where prohibited or restricted by law. Subject to all federal,
state and local laws and regulations. Participants who fail to comply with
any of the Official Rules of the Contest may be disqualified from the Contest
at the sole discretion of HE&R Contest officials. The decisions
of HE&R and its representatives shall be deemed final. By entering
this Contest all participants acknowledge having read these rules and agree
to be bound by them and the decisions of HE&R or its duly authorized
representative(s).
8. TAXES:
The Prize Winner is responsible for compliance with all applicable
rules, laws and regulations, including, but not limited to, payment of
applicable federal, state and local income taxes.
9. PRIZE WINNER INFORMATION:
For the name of the prizewinners please send self-addressed, postage-paid
envelope to: “97 tickets Contest”, c/o HE&R Marketing
Dept. 27 W. Chocolate Avenue, Hershey, PA 17033 by June 24, 2008.
